VERTEX is unique in that it offers real-world engineering and construction services as well as forensic and expert services. Thus, in construction defect matters, our experts can stand behind our opinions and offer to engineer a fix or bid any reconstruction work. If our clients require standard of care opinions, VERTEX can draw upon our talented pool of architectural, engineering, and construction experts to opinion whether subject conduct fell within industry standards. Lastly, our construction claims team is compromised of construction managers, schuedulers, and claims consultants that can prepare affirmative claims or prepare rebuttal reports.

Standard of Care

Law firms frequently look to VERTEX to provide standard of care opinions related to the conduct of architects, engineers, constructors, subcontractors, developers, manufacturers, surety claims handlers, among others. Because VERTEX offers AEC services in-house, our opinions carry significant weight as we “walk the talk”.

Cause & Origin

VERTEX’s team of architects, engineers, and constructors frequently testify to the cause of property damage and the reasonable repair protocol. Property damage typically involves building envelope issues, civil work, structural components, air quality issues, and environmental contamination problems.

Contract Claim Disputes

Our construction claims team prepare affirmative claims and rebuttal reports for disputes that involve: scheduling, scope, productivity, differing site conditions, maladministration, over-payment, unjust enrichment, default termination, etc. VERTEX works on claims that range from several thousand dollars to several hundred million dollars.

Fault Allocation

VERTEX offers fault allocation opinions on many of our cost of repair cases. VERTEX developed a five-step methodology for rendering fault-allocation opinions that our experts use on allocation matters.

Cost of Repair Estimating

To calculate the fair market cost to repair construction work, VERTEX estimators rely on decades of experience with projects that vary widely in scope and complexity. We typically base our assessments on one or more of the following: discussions with subcontractors, review of vendor pricing, review of construction cost data from widely used industry standard software packages, VERTEX’s historical pricing from the thousands of projects that VERTEX has estimated/completed as a general contractor, detailed quantity takeoffs, and site investigations. Lastly, VERTEX frequently tenders our cost estimates as bids to complete the work.

Mr. Phillips has over a decade of construction management and construction claim experience in the Rocky Mountain Region. Specific expertise includes: surety consulting and project completion, owner’s representation, construction oversight, construction claim analysis and preparation, construction defect cost estimating, liability review for construction defect matters, construction bid package preparation, and cost to complete preparation. As the Executive Vice President of Litigation Support, Mr. Phillips oversees contract claims and other legal consulting requiring environmental, engineering and construction expertise.

Mr. Dery has over 26 years of experience in structural engineering design and forensic investigations. Forensic investigations have been associated with residential and commercial building structures. Mr. Dery has provided workshops to engineering groups, building officials, and university students. Mr. Dery has developed in-house proprietary software for the analysis and design of hurricane force winds, seismic loads and snow load effects on buildings.

Mr. VanDemark has over 16 years of experience in Civil Engineering & Land Development and has a strong educational background in Structural Engineering & Engineering Management. Mr. VanDemark has provided comprehensive Civil Land Development Services on a multitude of projects including grading, drainage, utilities design in addition to erosion control, due diligence, jurisdictional coordination, entitlements, construction observation and project management. Additionally, Mr. VanDemark has provided Civil Forensics Services for projects that have included construction defects, cost to complete, standard of care, insurance claims, surety claims, allocation, eminent domain and appraisals.

Mr. Click has performed building evaluation services and has served as a technical expert for construction defect litigation matters since 1999. He is a registered Architect and licensed general building contractor, which enables him to opine on building assemblies from both a design and construction perspective. Mr. Click has provided facade inspection services to building owners and property managers and has developed repair scopes related to repair/restoration of facade and waterproofing assemblies.

Mr. Click’s areas of expertise include: building envelope investigation and failure analysis. He has worked on projects throughout the country performing forensic inspections, insurance loss control/underwriting support as well as evaluating homebuilder warranty repairs. Mr. Click’s experience includes involvement in numerous class action, single family home construction defect cases, where he assisted in the representation of homebuilders.
