VERTEX was retained to represent the General Contractor in this construction defect case involving a multifamily housing project. We performed forensic evaluations of the project to assess claims asserted by the HOA’s expert. The nature of the issues claimed by Plaintiff’s expert involved building envelope conditions including exterior walls, roofing, waterproofing, windows and doors, and sealant joints. Plaintiff’s claims also included structural and plumbing issues. Due to VERTEX’s sizeable staff of engineers and architects, our attendance at frequent site visits for Plaintiff’s ongoing investigations, as well as our quick responses to last minute emergency repair notifications, enabled VERTEX to observe and document key as-built conditions. VERTEX’s defense response, cost of repair estimate, and deposition testimony contributed to the case settling for over $30 million below the total amount claimed by Plaintiff. Our wide variety of experts allowed the carrier and counsel to use VERTEX as a single source for their expert witnesses, rather than having to coordinate with multiple consulting firms for multiple disciplines.
