VERTEX was the delay expert for a general contractor in a dispute with the Owner in an arbitration proceeding. The project was a 312-unit residential apartment development that consisted of six 3-story wood-framed walk-up style residential buildings, parking structure, and clubhouse building. The Owner initiated the dispute with a multimillion-dollar claim against the contractor for liquidated damages, and the contractor had a counterclaim for delay damages and other amounts. VERTEX reviewed issues and delay events on the project, including the late establishment of permanent power, and performed a contemporaneous period analysis to evaluate and allocate delays. VERTEX provided testimony at the arbitration proceedings, and the contractor was ruled to be the prevailing party, with the arbitrator indicating in the award the credible testimony and opinions proffered by VERTEX on scheduling issues.
