VERTEX had two named experts in the matter who collectively evaluated the performance and termination of a joint venture partner, and the reasonableness and quantum of damages to complete the work and settle payment claims. VERTEX prepared six expert reports on the matter, which included review of delay issues, payment reconciliation, evaluation of reasonableness of termination and completion cost mitigation, review of defective work, cost estimating, funds tracing, and computation of damages under various legal theories and interest models. VERTEX also analyzed the terminated member’s expert analyses related to a separate litigation to determine if the costs claimed in that matter were actually incurred and paid. VERTEX provided deposition testimony in the matter, and the case ultimately settled pre-trial.
