VERTEX was retained by counsel as a delay, productivity, and damages expert for a heavy/civil contractor who constructed a 3.9-mile waterfront trail, which crosses portions of Maryland and Washington, D.C. The trail includes four (4) new pedestrian bridges and one (1) boardwalk spanning portions of the river and its tributaries, with deep foundation work for the project consisting of a combination of caissons and helical piles.
VERTEX performed a Windows Analysis and causation review to evaluate Owner-caused delays and their resulting damages. An entitlement review for differing site conditions and a measured mile productivity analysis was also performed for the boardwalk caisson installation to calculate loss of productivity and associated labor, equipment, and testing costs. Finally, scope damages associated with changes and directives were reviewed for entitlement and quantum. Because the project spanned both Maryland and DC, two separate expert reports were prepared for claims and damages against MDOT and DDOT respectively. Both claims settled pre-trial.
