VERTEX was retained as a delay and damages expert by counsel for a developer in a dispute with its terminated general contractor on a solar farm project in Iowa County, Wisconsin.
The project involved the construction of a new solar farm consisting of approximately 500,000 solar panels. VERTEX assessed the general contractor’s claims for schedule relief and price increases due to COVID-19, civil redesign, and module engineering changes. VERTEX also quantified delay liquidated damages and other discrete damages the developer incurred to remediate and complete the terminated general contractor’s work.
VERTEX issued affirmative and rebuttal expert reports, provided deposition testimony, and provided testimony at arbitration. VERTEX is awaiting the arbitration tribunal’s ruling.
