Course Description: During projects there are always unknowns encountered. When these unknowns are confronted as defects in construction, these can cause trouble for the Contractor, Owner, and even in some cases the Designer. Defects can occur during the lifecycle of the project or can appear after the contractor has already demobilized the project. In this presentation Mark Gobitas and Gisel Hernandez will discuss the difference between latent and patent defects and how they each affect a project. This course will also discuss the challenges to close a contract when construction defects arise before turnover and what mechanisms in place can be used to mitigate these issues upon discovery. Moreover, Mark and Gisel will also provide different scenarios on how sureties and insurance companies can handle defects and their limitations depending on the scenario.
