VERTEX was retained to provide a defense response to plaintiff claims for this project, which is located on the shoreline of the upper New York Bay in Jersey City, New Jersey and consists of several mid-rise buildings and townhouse cluster buildings, as well as a clubhouse and other common area amenities (total of 430 residential dwelling units). VERTEX performed site inspections, analyzed the plaintiff claim report, reviewed construction documents and contracts, estimated the cost to repair based on both plaintiff scope of work and proposed defense scope, and summarized the findings for the defense response. VERTEX’s building envelope and structural expertise were utilized to determine which of the plaintiff’s claimed issues necessitated repairs, and then provided cost-effective ways of making such repairs. VERTEX’s detailed analysis and backup documentation provided the client with clear and concise responses to Plaintiff’s alleged claims. Due to VERTEX’s sizeable staff of engineers and architects, our attendance at frequent site visits for Plaintiff’s ongoing investigations, as well as our quick responses to last minute emergency repair notifications, enabled VERTEX to observe and document key as-built conditions. VERTEX’s experience with providing testimony proved extremely beneficial, as complex issues were described by VERTEX experts in clear and concise ways in deposition. VERTEX’s defense response and cost of repair estimate contributed to the case settling for $ millions below the total amount claimed by Plaintiff.
